Dr. Robert Levy
Today at MSU College of Law, Dr. Robert Levy, Senior Fellow in Constitutional Studies at the Cato Institute, gave a very thought-provoking speech about his new book entitled “The Dirty Dozen: How Twelve Supreme Court Cases Radically Expanded Government and Eroded Freedom.” Dr. Levy has graciously agreed to take some time to answer a few of your questions regarding this topic. Please post your questions here.

Dr. Levy, in light of Kelo’s SCOTUS decision and the wave of “Anti-Kelo” legislation in about 40 states, are there any eminent domain cases heading again to the SCOTUS now that the justices “line-up” is different?

As far as I know, there are no other Kelo-type cases now heading to the Supremes. In the wake of Kelo, all the action has shifted to the state legislatures and courts. Of course, that could change — especially because new state laws and constitutional provisions are weakening the argument that stare decisis should control at the federal level. There are few settled expectations arising out of a federal decision (Kelo) that is being trumped by the states.
