As far as I know, there are no other Kelo-type cases now heading to the Supremes. In the wake of Kelo, all the action has shifted to the state legislatures and courts. Of course, that could change -- especially because new state laws and constitutional provisions are weakening the argument that stare decisis should control at the federal level. There are few settled expectations arising out of a federal decision (Kelo) that is being trumped by the states.

Dr. Levy, in light of Kelo's SCOTUS decision and the wave of "Anti-Kelo" legislation in about 40 states, are there any eminent domain cases heading again to the SCOTUS now that the justices "line-up" is different?
